TO THE FULLEST EXTENT PERMITTED BY LAW, TRAFFIC EXPERT WITNESS AND ITS MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL LIABILITY ARISING OUT OF THE USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100).
These limitations do not apply to liability that cannot be limited under applicable law, and they do not apply to services provided under a separate written engagement agreement, which is governed by its own terms.
11. Indemnification
You agree to indemnify and hold harmless Traffic Expert Witness and its members, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms or your misuse of the Site.
12. Governing law and venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles.
Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.
13. Changes to the Site and these Terms
We may change, suspend, or discontinue any part of the Site at any time. We may also revise these Terms; the effective date above indicates when they were last revised.
Your continued use of the Site after a revision means you accept the revised Terms.
14. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver.
These Terms, together with the Privacy & Copyright Policy and Cookie & Consent Policy, are the entire agreement between you and Traffic Expert Witness regarding use of the Site.
